1. Acceptance of Terms

By accessing, browsing, or using the CaSocialSpin website located at casocialspin.com ("the Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Cookie Policy. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and CaSocialSpin ("we," "our," or "us"). You shall not impersonate any person or entity, or misrepresent your affiliation with any person or entity when using the Platform or contacting our support team.

6. Intellectual Property

All content, materials, and elements of the CaSocialSpin platform, including but not limited to the website design, layout, graphics, animations, game mechanics, user interface elements, text, logos, the CaSocialSpin brand name and logo, the Tropical Fruit Spinner game name and design, source code, compiled code, software, databases, and all other proprietary content (collectively, "Platform Content"), are the exclusive intellectual property of CaSocialSpin and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform Content solely for your personal, non-commercial entertainment purposes in accordance with these Terms. 7. Virtual Points and Game Mechanics

The Tropical Fruit Spinner and any other games on the CaSocialSpin platform use virtual point systems for entertainment scoring purposes only. Virtual points are generated through gameplay and have absolutely no real-world monetary value. You acknowledge and agree that: virtual points are not a form of currency and cannot be purchased, sold, or exchanged for real money or anything of value; CaSocialSpin has no obligation to maintain, support, or continue the availability of virtual points or any scoring system; virtual points may be reset, modified, or removed at any time without prior notice; all game outcomes are determined by random number generation algorithms and no skill, strategy, or spending can guarantee specific results; and the difficulty multiplier settings (Easy 1x, Medium 1.5x, Hard 2x, Expert 3x) affect only the rate of virtual point accumulation and do not alter game probability mechanics. The game is provided purely for entertainment purposes, and no element of the game constitutes or simulates real-money gambling.

THE CASOCIALSPIN PLATFORM AND ALL CONTENT, GAMES, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. CASOCIALSPIN DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. CASOCIALSPIN DOES NOT WARRANT THAT ANY DEFECTS WILL BE CORRECTED OR THAT THE PLATFORM WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS. YOU USE THE PLATFORM ENTIRELY AT YOUR OWN RISK. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE PLATFORM IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, IN NO EVENT SHALL CASOCIALSPIN, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF CASOCIALSPIN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL CASOCIALSPIN'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE AMOUNT OF TEN CANADIAN DOLLARS (CAD $10.00). THIS LIMITATION OF LIABILITY IS A FUNDAMENTAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN YOU AND CASOCIALSPIN, REFLECTING THE FREE NATURE OF THE PLATFORM AND THE ABSENCE OF ANY FINANCIAL TRANSACTIONS. SOME CANADIAN PROVINCES AND TERRITORIES MAY NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, IN WHICH CASE THESE LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

10. Indemnification

You agree to defend, indemnify, and hold harmless CaSocialSpin, its officers, directors, employees, agents, licensors, suppliers, and any third-party information providers from and against all losses, expenses, damages, liabilities, and costs, including reasonable attorneys' fees, arising out of or related to: your use or misuse of the Platform; your violation of these Terms; your violation of any rights of another person or entity; your violation of any applicable Canadian law, regulation, or ordinance; any content or information you submit or transmit through the Platform, including through the contact form; or any negligent or wrongful conduct by you. This indemnification obligation will survive the termination of these Terms and your use of the Platform. CaSocialSpin reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate fully with our defense of any such claim.

11. Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of Canada and the applicable laws of the Province of Ontario, without regard to conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms, or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall first be subject to good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, either party may submit the dispute to the courts of competent jurisdiction in the Province of Ontario, Canada. You agree to submit to the personal jurisdiction of such courts and waive any objection to the convenience of such forum. Notwithstanding the foregoing, CaSocialSpin may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of its intellectual property rights.

12. Changes to These Terms

CaSocialSpin reserves the right to modify, amend, or replace these Terms of Service at any time at our sole discretion. When we make material changes, we will update the "Last updated" date at the top of this page. We may also provide notice of significant changes through a prominent notice on the Platform. It is your responsibility to review these Terms periodically for changes. Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes.
